Spain: Supreme Court supports CNMC – Honda and Suzuki sentence upheld

The Supreme Court of Spain has backed the sanctions imposed against the companies Montesa Honda and Suzuki Motor Spain, accused of entering into agreements to pass the cost of a new Circulation Tax directly on to their customers.

The court found that there had been direct contact via email between the two multinationals to reduce uncertainty in the market on whether the new tax on prices would be passed on and how it would be done.

The CNMC celebrated the “important pronouncement” expressed in the judgments of the Supreme Court, “because it emphasizes the anti-competitive nature of certain practices, such as the exchange of relevant information between competitors”.
